WARRANTY POLICY
1. DAOU LIGHTING LUMINAIRE WARRANTY
1.1 HAINING DAOU LIGHTING CO.,LTD. , referred to herein as “ DAOU LIGHTING ”, warrants its products to be free from defects of material and workmanship for a period of three ( 3 ) or five ( 5 ) years for LED luminaires of architectural and technical range, DAOU LIGHTING will under Warranty obligation, repair or replace defective part / product at their discretion.
2. THE WARRANTY ONLY APPLIES TO THE PRODUCTS SUBJECT TO THE FOLLOWING CUMULATIVE CONDITIONS
2.1 The Product has been used in accordance with the given Product and application specifications (data sheets) and has been installed and put into service in a professional manner (according to the installation instructions enclosed with the Product or upon request from DAOU LIGHTING ).
2.2 Temperature and voltage limits must not be exceeded.
2.3 The Product must not be exposed to any mechanical stresses and strains that are not in accordance with its intended purpose and/or chemical environment.
2.4 The Customer has duly paid for the Product in compliance with the payment terms agreed in the sales agreement.
2.5 The defect, once it has been duly specified and its nature and scale have been duly shown by the Customer, is reported in writing to DAOU LIGHTING within thirty ( 30 ) days from its discovery.
2.6 The Product must not have been modified or altered.
2.7 The Product has been installed by a professional qualified installer; and the Product has been installed with a compatible control system where applicable.
This Warranty does not apply to any Product or part that has been subject to misuse, negligence, accident, use outside of Product design intent, or attempted repair/modification by anyone other than DAOULIGHTING. DAOU LIGHTING’s sole liability for defects or breach of Warranty shall be replacement of the parts involved, and, in no event will DAOU LIGHTING be liable for special or consequential damages or losses including property damage or other loss as related directly or indirectly to the use of luminaires. In no event is DAOU LIGHTING liable for consequential damages or personal injury caused by installation and transportation or negligence during installation and transportation or adjustment. DAOU LIGHTING claims no liability for the cost of installation or any other cost incurred during the use of Products manufactured by DAOU LIGHTING. No representative is authorized to assume additional liability for DAOU LIGHTING.
3. DEFINITION OF DEFECTS
3.1 LED defects including over 5% of LEDs failed or burn out, loose, broken, un-workable PC board etc. Technical and material, workmanship of the Product can be considered defects under this Warranty obligation.Driver defects including functional problems, power factor etc. which affect the solid function of the Product will be considered as defects under this Warranty obligation.
4. HOW TO MAKE A WARRANTY CLAIM
4.1 To make a Warranty claim, the Customer shall notify and return the defective Product to DAOU LIGHTING. All claims must be made in writing by email to the customer service department of DAOU LIGHTING within 30 days after discovery.
4.2 The Customer will be required to provide a documented record of the installation date, and installation location of the Product and the claimed failure. Furthermore, receipt, invoice or other proof of purchasewill be requested to accredit the Product purchase and date.
4.3 DAOU LIGHTING reserves and has the right to examine the Product to determine the cause of failure and patterns of usage. If, for any reason, the defective Product cannot be returned, DAOU LIGHTING may require that one of its staffs be given access to the installation in order to, carry out the necessary quality inspections to determine the claimed failure cause. Alternatively, and in order to help DAOU LIGHTING determine whether the Warranty applies, DAOU LIGHTING reserves the right to request that its Customer provide their incident log book showing proven defects on the basis of which they wish the Warranty to applyor any other elements that would support their Warranty claim.
4.4 If the above mentioned documents, information and access provided by the Customer are not suficient to enable DAOU LIGHTING to confirm the validity of the Warranty claim, DAOU LIGHTING reserves the right to ask the Customer to provide additional documents, information and access or anything else as may be required by DAOU LIGHTING.
5. IMPLEMENTATION OF THE WARRANTY
5.1 When a Warranty claim is justified, DAOU LIGHTING will, at its discretion, repair or replace only the defective Product or reimburse the Customer the Product purchase cost.
5.2 The replacement Product will offer the same specifications as the original Product wherever possible. In case the defective Product is no longer available in DAOU LIGHTING’s range, it will be replaced by the most similar product. Replaced Products or replaced parts of the Product shall be covered under the initial Warranty for the remainder of the applicable warranty period for the Product that is replaced.
5.3 All returns must be factory authorized and DAOU LIGHTING must issue a Return Material Authorization (RMA), prior to shipping. Returns will be shipped at Customer’s expense. DAOU LIGHTING will bear expensesfor the shipment of the replacement Product. In no case will DAOU LIGHTING be liable for any costs incurred by the removal of the defective Product and reinstallation of the repaired or replacement Product (or any labour costs).
5.4 If DAOU LIGHTING finds the product working properly, Customer may be billed for testing, repackaging, and shipping. If Warranty has expired, DAOU LIGHTING will provide a quote to repair prior to making anysuch repairs.
6. EXCLUSIONS
6.1 This Warranty does NOT cover the following:
• Defective Product caused by modifications, alterations, drop, abuse, misuse, abnormal use or acts of God;
• Costs or expenses made for removal or re-installation of the Products;
• Sample Products;
• Failure caused by fire, flood or lightning strike of the installation;
• Consequential damages (such as but not limited to loss of revenue/profits or damage to property).
7. GENERAL TERMS
7.1 This Warranty policy is a standard application of DAOU LIGHTING. No other third party (including any agents, distributors or sales representatives) is authorized to make any representations or warranties that aredifferent from this Warranty Policy. Unless otherwise confirmed by DAOU LIGHTING in written forms of contract or other documents, any Warranty clauses that confict with this Warranty Policy shall be deemed to be automatically invalid. Final power of interpretation of this Warranty policy shall be be vested in DAOU LIGHTING.
